Abstract

[ES] Este trabajo tiene como objeto analizar la posible comisión de un delito continuado de estafa por parte de unos constructores-promotores de viviendas que, vendieron unas parcelas de su propiedad a terceros, con una edificabilidad de doscientos metros cuadrados cada una, cuando sin embargo, unos años antes de la venta, los referidos constructores-promotores habían transmitido al Ayuntamiento de La Guardia la edificabilidad de dichas fincas a otra parcela mayor de “Equipamientos Sociales” para la construcción de una Residencia de la Tercera edad por lo que la edificabilidad es cero. El presente dictamen atiende a las pretensiones de la parte perjudicada o querellante, uno de los compradores, y viene a desgranar todo el proceso judicial iniciado con la interposición de querella criminal por el delito de estafa, cometido por los referidos constructores-promotores, en la que se reclama a éstos una indemnización de daños y perjuicios causados a mi representado, quien confiado en la apariencia registral que presentaba la parcela, adquiere la misma cuando, de haber conocido su verdadera edificabilidad, no la hubiera adquirido o bien lo hubiera hecho por menor precio.

[EN] The goal of this work is to analyze a possible continuing offence fraud task by some builders, building promoter, they sold some building land plots, each one with two hundred square-meter of buildability, to third parties, however, that buildability had been moved to La Guardia town hall to bigger social Infrastructures plots for a residence for the elderly home building some years before the sale by the aforementioned builders. The current ruling attends to the plaintiff intentions, one of the purchasers, in order to break up the initiated court proceedings with the filling of a criminal lawsuit for the fraud offence committed by the mentioned builders, in that a compensation for damages and prejudices caused to my defendant, who would not have bought the building plot or would have bought it at a lower cost, if he had known the reliable buildability, is claimed.
