DISCURSO DEL ODIO Y LIBERTAD DE EXPRESIÓN

Abstract

[ES] En los últimos años estamos constantemente oyendo hablar del término discurso del odio en diferentes medios de comunicación, especialmente en televisión y redes sociales. El origen de este concepto es un poco confuso, pero lo que está claro es que fue tras la entrada en vigor del Código penal de 1995 cuando realmente empezó a ser punible, tras la reforma de 2015 las conductas y la pena de prisión aumentaron. Tanto la jurisprudencia como la doctrina están divididas, la cuestión sería averiguar si el discurso del odio debe ser o no castigado, los que dicen que no, se amparan en la libertad de expresión como derecho fundamental de la sociedad, por el contrario los que sí castigarían, se basan en la tolerancia y en el derecho a respetar a grupos y minorías. Pensamos que ambas cosas pueden ser complementarias, pero si tuviéramos que posicionarnos apoyaríamos la primera opción.

[EN]In recent years we are constantly hearing about the term “hate speech” in different media, especially in television and social networks. The origin of this concept is a little confusing, but what is clear is that it was after the entry into force of the Criminal Code of 1995 when it really began to be punishable, after the reform of 2015 the conduct and imprisonment increased. Both jurisprudence and doctrine are divided, the question would be to find out whether the “hate speech” should be punished or not, those who say no, are protected in freedom of expression as a fundamental right of society, on the contrary, those who would punish it, are based on tolerance and the right to respect groups and minorities. We do think that both things can be complementary. However, but if we had to make a decision, we would support the first option.
