Abstract

[ES] Dada la importancia del sector olivarero en España, y más concretamente en Andalucía, se hace especialmente atractivo el estudio de la fiscalidad de este sector de actividad. Es por ello que el objeto del presente estudio ha sido el análisis de la fiscalidad tanto directa como indirecta del olivar, comparando así el sistema español con el sistema italiano como principal referente comparado en el sector del aceite de oliva. Analizaremos tanto el régimen de estimación objetiva como el régimen de estimación directa del IRPF concluyendo cuál de ellos ostenta menor carga fiscal para el empresario. Siendo la sociedad cooperativa la forma societaria más usual entre los empresarios oleícolas, estudiaremos así las particularidades existentes en cuanto a la fiscalidad de éstas en relación con el resto de formas societarias pues ha sido un régimen muy criticado. Por último, trataremos de analizar el régimen aplicable en cuanto a la Seguridad Social.

[EN] Because of the importance of the olive sector in Spain, and more specifically in Andalucia, it is particularly attractive to study the taxation of this sector of activity. That is why the object of this study has been the analysis of both direct and indirect olive taxation, comparing the Spanish system with the Italian system as the main benchmark in the olive oil sector. We will analyze both the objective estimation regime and the direct estimation of personal income tax regime, concluding which of them has a lower tax burden for the employer. As the cooperative society is the most common corporate form among oil entrepreneurs, we will study the particularities that exist in terms of the taxation of these in relation to the rest of the corporate forms, since it has been a highly criticized regime. Finally, we will try to analyze the applicable regime in terms of Social Security.
