EL DERECHO SANCIONADOR TRIBUTARIO DESDE LA PERSPECTIVA DE LOS DERECHOS FUNDAMENTALES

Abstract

[ES] Analizamos el procedimiento sancionador tributario desde la perspectiva de los derechos fundamentales, es decir, la incidencia sobre estos derechos del ejercicio de la potestad sancionadora. Comenzamos con una aproximación a los fundamentos de la potestad sancionadora. Debimos descender al plano de los hechos para detectar las situaciones de conflicto, y las respuestas que ha ofrecido la práctica administrativa y el propio legislador, a través de las sucesivas reformas. No obstante, destacamos los nuevos atentados que podrían provocar algunos cambios normativos. Por ultimo nos referimos de manera detallada y crítica a los derechos que resultan afectados como consecuencia de este procedimiento, y más concretamente el derecho a la no autoincriminación.

[EN] We analyze the tax sanctioning procedure from the perspective of fundamental rights, that is to say, the impact of these rights on the exercise of the sanctioning power. We begin with an approach to the foundations of the sanctioning power. We should descend to the levels of the facts to detect the circumstances of conflict, and the responses that the administrative practice and the legislator have offered, through successive reforms. Nonetheless, we highlight the new attacks that could cause some regulatory changes and refer in a detailed and critical way to the rights that are affected as a result of this procedure; more specifically, the right to no self-incrimination.
