[ES] La inviolabilidad, la inmunidad y el aforamiento son garantías procesales que conceden a sus titulares una ventaja respecto de otros ciudadanos por la función que realizan o el cargo que desempeñan. Específicamente, el aforamiento supone ser juzgado por un Tribunal Superior de Justicia o por un tribunal Supremo, en vez de ser investigado por el juez ordinario correspondiente. Durante los últimos años estamos viendo como se está hablando cada vez más sobre la necesidad o no de la figura del aforamiento. Se trata de un tema que suscita últimamente mucho debate y a la vista está. En España esta prerrogativa se está viendo afectada principalmente por dos motivos, uno es que contamos con un número excesivo de personas que ostentan esta condición y por otro lado sería necesaria una revisión del aforamiento en nuestro país ya que el objetivo principal de esta prerrogativa se está transformando y se está llevando a la confusión, es decir se está haciendo de ella un privilegio personal.
[EN] The inviolability, the immunity and the appraisal are procedural guarantees that grant their holders an advantage over other citizens by the function they perform or the position they perform. Specifically, the appraisal supposes to be judged by a Superior Court of Justice or by a Supreme Court, instead of being investigated by the corresponding ordinary judge. During the last years we are seeing how more and more people are talking about the need or not of the figure of the appraisal. It is an issue that recently sparks much debate and is in sight. In Spain this prerogative is being affected mainly for two reasons, one is that we have an excessive number of people who hold this condition and on the other hand a revision of the appraisal in our country would be necessary since the main objective of this figure is transforming and leading to confusion, that is, it is becoming a personal privilege.
