Abstract

Con este estudio lo que pretendo es profundizar en la problemática social y judicial de la maternidad en mujeres discapacitadas. Las mujeres discapacitadas para el ejercicio de su maternidad están siendo doblemente discriminadas, por un lado, por los prejuicios sociales que determinan que no están capacitadas para ser madres, y por otro lado, por la práctica extendida de la esterilización y del aborto con motivos eugenésicos, que veremos en profundidad a lo largo del estudio. Otro elemento desarrollado en nuestro estudio, serán las limitaciones que tienen este grupo social para la crianza de los hijos, así como, la diferencia discriminatoria entre los hombres y mujeres discapacitados en el ámbito de la paternidad y maternidad.

In the study I expect to go indepth in the social and judicial maternity problem with mentally handicapped women. These disabled woman are distinguished by many reasons. On the one hand, the social prejudices resolve that they aren´t prepared to be mothers. And on the other hand, the widespread practice of sterilization and abortion with eugenic connotations which we will study deeply throughout this study. Another ítem developed in this study will be the limitations which this social group has with the upbringing of their children. Moreover, we will pay attention to the discriminatory difference between disabled women and man and their maternity and paternity respectively.
