[ES]En nuestro estudio analizamos las reformas que afectan al ámbito sancionador en materia tributaria y la mejora que tal evolución ha representado para las garantías y derechos de los contribuyentes. Cada modificación en la materia, lleva implícita un determinado código de valores en el legislador, una distinta concepción del proceso y de la posición del contribuyente ante el mismo, por lo que nuestro estudio se centra necesariamente en los sucesivos cambios de paradigma científico que se hallan en la base de las reformas. Por supuesto, no podemos prescindir de la descripción el procedimiento mismo, para ubicarnos convenientemente en la materia cuyas modificaciones debieran aspirar a incrementar la protección y garantía de los derechos del contribuyente.

[EN]In our study we analyze the reforms that affect the sanctioning area in tax matters and the improvement that this evolution has represented for the guarantees and rights of the taxpayers. Each change in the subject implies a certain code of values in the legislator, a different conception of the process and the position of the taxpayer before it, so our study necessarily focuses on the successive changes of scientific paradigm that are on the basis of reforms. Of course, we can not dispense with the description of the procedure itself, in order to place ourselves suitably in the matter whose modifications should aim to increase the protection and guarantee of the rights of the taxpayer.
