Abstract

[ES]En el presente trabajo se va a llevar a cabo un análisis sobre los esfuerzos de la comunidad internacional en la lucha contra el terrorismo internacional y la complejidad de abordar este fenómeno. Haremos un pequeño estudio sobre la posibilidad de considerar al terrorismo como crimen internacional autónomo, o en base a su naturaleza jurídica, como un subtipo de crimen de guerra o lesa humanidad. Por otra parte, se hace patente la relevancia acerca de la competencia que la Corte Penal Internacional tiene sobre el Terrorismo, además de la mención de tribunales ad hoc, también capacitados para enjuiciar este tipo de delito. Comentaremos la ardua labor de las Naciones Unidas y el Consejo de Seguridad en la lucha contra el terrorismo.

[EN]In the present work, an analysis on the efforts of the international community in the fight against international terrorism and the complexity of addressing this phenomenon. We will make a study on the possibility of considering terrorism as an autonomous international crime, or, based on its legal nature, as a subtype of war crime or against humanity. On the other hand, the relevance of the International Criminal Court's jurisdiction over terrorism is evident, as well as ad hoc tribunals, also qualified to prosecute this type of crime. We will comment on the hard work of the United Nations and the Security Council in the fight against terrorism.
