[ES]A lo largo de este trabajo vamos a analizar el problema de la vulneración del derecho a la tutela judicial efectiva, reconocido tanto en nuestra Constitución como en los tratados internacionales ratificados por España, cuando es el Tribunal Supremo el que conoce de la causa contra una persona aforada en primera instancia, ya que el condenado por este tribunal se ve privado de su derecho a que el fallo del tribunal y la pena sean revisadas por un tribunal superior. Posteriormente, veremos el tratamiento que nuestros tribunales para, por último, valorar algunas alternativas al problema objeto del presente trabajo.
[EN]Along this work we are going to analyze the problem of the violation of the right to the judicial effective guardianship, recognized both in our Constitution and in the international agreements ratified by Spain, when it is the Supreme Court the one that knows about the reason against a person appraised in the first instance, since the reprobate for this court meets deprived of his right to which the failure of the court and a sorrow they are checked by a top court. Later, we will see the treatment that our courts, finally, some alternatives value to the problem object of the present work.
