[EN]“Mediation and Conciliation in the Juvenile Justice System” is the title of my final degree project. Firstly, it shows a global vision of all juvenile justice system, such as principles, legislative history, the current Organic Law of Juvenile Criminal Responsibility, measures imposed, and the civil liability for damage. Secondly, this project focus on extrajudicial solutions, that has to take into account the legislative history, the principles and goals, the crucial requirements to commence the process. Additionally, the adopted measures, the subjects involved in the dispute, and the advantages and disadvantages of its application. To conclude, this project includes statistics that reveal the crimes committed by juveniles during the years 2014, 2015 and 2016, in the Public Prosecutor's Office and Juvenile Court of Jaén, along with the implemented measures. Henceforth, bearing in mind these facts, it could be assume and understandable the percentages of extrajudicial measures application.
[ES]En primer lugar, se muestra una visión global de todo el entramado del sistema penal juvenil, como los principios, los antecedentes legislativos a la actual Ley Orgánica de la Responsabilidad Penal del Menor, la imposición de las medidas, y la responsabilidad civil derivada del delito. En segundo lugar, se centra en las soluciones extrajudiciales, exponiendo sus antecedentes legislativos, sus objetivos y principios, los requisitos indispensables para que el proceso pueda iniciarse, las medidas que se adoptan, los sujetos intervinientes y las ventajas y desventajas de su aplicación. En tercer lugar, se incluye el apartado de estadísticas, donde se pone de manifiesto los tipos de delitos cometidos durante los años 2014, 2015 y 2016 en la Fiscalía y Juzgado de Menores de Jaén, junto con las medidas impuestas, y los porcentajes de aplicación de mediación y conciliación.
