Robo y Hurto de uso de vehículos

Abstract

[ES] En el presente trabajo de Fin de Grado, analizaremos y estudiaremos el artículo 244 del Código penal español, ubicados en el Titulo XIII, Capitulo IV. Tras la reforma que se ha producido en el año 2015, en multitud de artículos del Código penal, entre ellos el artículo 244, vamos a analizar como afectó esta reforma a este artículo concreto, y cuales han sido las modificaciones que se han producido. Posteriormente, vamos a analizar cada uno de los párrafos del artículo, haciendo uso de los artículos previos a este, los cuales se refieren al hurto y al robo con violencia o intimidación en las personas, y al robo con fuerzas en las cosas, ya que, es importante tener unos conocimientos previos sobre estos tipos de delitos para poder entender y estudiar el artículo 244. Gran parte del trabajo consiste en el análisis detallado y profundo de todos sus párrafos. Por último, se analizará el momento de consumación del delito, así como la pena impuesta para este tipo de delitos. Expondré unas conclusiones finales sobre el artículo y sobre la reforma que se hizo en el año 2015, además de mencionar algunos ejemplos que he considerado de gran relevancia.

[EN] In this dissertation, the article 244 of Spanish Penal Code, located in the Title XIII, Chapter IV will be analysed. After the reform of many articles of this Penal Code in 2015, it is going to be studied how Article 244 has been modified and its consequences. Afterwards, you could find a detailed analysis of each article paragraph. This is related with the previous articles referred to larceny, violent robbery or robbery with intimidation from people and things. A previous knowledge of these crimes would be essential to study article 244. Finally, the moment of crime perpetration will be reviewed, as well as the imposed sentence on these types of crimes. Some ending conclusions about the article and the reform in 2015 are presented with some relevant examples.
