El contrato de compraventa

Abstract

[ES]El objetivo principal de este trabajo “Fin de Grado”, es hacer un recorrido por el Código Civil, en su Título IV, de su Libro IV, centrándome principalmente en el contrato de Compraventa y sus principales características y peculiaridades que lo componen. Veremos su concepto y características principales, haré una comparativa entre contrato de compraventa civil y contrato de compraventa mercantil, así como los elementos de la compraventa (personales, reales y formales). Me centraré en las obligaciones de las partes tanto por parte del comprador en pagar el precio de la cosa, como por parte del vendedor en entregar la cosa, de acuerdo a las formas que establece el Código, así como sus requisitos. Indagaré en el Saneamiento en los diferentes casos y algunas especialidades, así como los riesgos en la compraventa, las garantías del vendedor, la venta de una misma cosa a diferentes compradores, compraventa con pacto de retro, el pacto de reserva de dominio, compraventas especiales. Y finalizaré con las conclusiones del trabajo, adjunto también un anexo en el que plasmo un modelo de contrato de compraventa, continuando con el índice de la jurisdicción que he consultado, y por último con la bibliografía.

[EN]The main objective of this work "End of Degree" is to make a tour of the Civil Code, in its Title IV, of its Book IV, focusing mainly on the contract of Sale and its main characteristics and peculiarities that compose it. We will see its concept and main characteristics; I will make a comparison between civil contract of sale and commercial contract of sale, as well as the elements of the sale (personal, real and formal). I will focus on the parties' obligations both on the part of the buyer in paying the price of the thing, and on the part of the seller in delivering the thing, according to the forms established by the Code, as well as its requirements. I will inquire in the Sanitation in the different cases and some specialties, as well as the risks in the purchase and sale, the guarantees of the seller, the sale of the same thing to different buyers, purchase and sale with pact of retro, the pact of domain reservation, . And I will conclude with the conclusions of the work, I also enclose an annex in which I formulated a model of contract of sale, continuing with the index of the jurisdiction that I consulted, and finally with the bibliography.
