Abstract

El presente trabajo de fin de grado tiene por objeto efectuar un análisis de la figura del despido del trabajador en su vertiente disciplinaria. Siendo conscientes de la complejidad de la materia sobre la que versa el trabajo, así como de las limitaciones que a su contenido impone su longitud máxima, hemos intentado efectuar un análisis acerca de las causas que, en el ordenamiento laboral español pueden fundamentar un despido disciplinario; la forma que debe revestir la comunicación de despido; su calificación de procedencia, improcedencia o nulidad, y sus correspondientes efectos. Para la realización del trabajo he usado los recursos bibliográficos que proporciona la Universidad de Jaén, tanto en lo que se refiere a libros, como a bases de datos; he recurrido también a otros muchos textos, obtenidos de muy diversos medios, si bien destacan los artículos de la revista Temas Laborales, editada por el Consejo Andaluz de Relaciones Laborales. Por último, quisiera matizar que las referencias hechas en el trabajo a (v.gr.) “los trabajadores”, “los representantes”, “los delegados de personal” incluyen, como no podía ser de otro modo, también a las trabajadoras, las representantes, las delegadas de personal, y así un largo etc. Vayan por delante mis disculpas por esa manera de utilizar el lenguaje, que se fundamenta en el principio de economía del lenguaje.

The present Final Thesis aims at conducting an analysis based on the figure of the disciplinary dismissal. Given the very complex nature of this subject , together with the limitations imposed by the length that this paper is subject to, we have tried to analyse the causes that, according to the Spanish legal system, can be based on the way in which the communication of this dismissal should be accomplished, its labelling as lawful, unlawful or null, and its corresponding effects. For the development of the present analysis, the various bibliographical resources provided by the University of Jaén have been employed, thus comprising both books and databases. It is worth highlighting that, apart from that, other texts coming from different sources have been used; in this respect it is necessary to mention the articles from the journal “Temas Laborales” (Labour Issues), edited by “Consejo Andaluz de Relaciones Laborales” (Andalusian Council of Labour Relations), which have played a major role within this research. Finally, I would like to expand on the fact that, when using terms such as “workers”, “representatives” or “personnel delegates”, both men and women are included. I should, therefore, apologise for this way of using the language which, at any rate, is based on the principle of linguistic economy.
