Maternidad subrogada en derecho internacional privado español

Abstract

[EN]During the following investigation work, issues due to the mother surrogates contracts such as its effects and its consequences will be developed. Difficulties for the filiation determination, tittles recognition supporting filiation, as well as the Registry of Vital Records inscription; will be analyzed. In addition to this, several sentences and resolutions compiled on the 2009 February 18th DGRN regarding the controversial filiation's inscription on the Registry Vital Records of a few Childs born through surrogate (in California - USA) will be deeply reviewed. The DGRN's 20l0 October l0th Instruction is also exposed, as it provides several guidelines to Validate the filial relationship turned up from that contract, as the Instruction determinates the foreign judgment resolution as a valid document for the Registry of Vital Records filiation's inscription. Finally, conclusions about the topic are given. Besides, the bibliography in which this investigation work has been based is exposed.

[ES]En el presente trabajo se desarrolla la problemática que conllevan los contratos de maternidad subrogada, así como sus efectos y consecuencias. Se analizan las dificultades, tanto de la determinacion de la filiación, el reconocimiento de los títulos que avalan dicha filiacion, como la inscripción en el Registro Civil. Ademas, se estudian una serie de sentencias junto con la resolución de la Dirección General de los Registros y del Notariado, de 18 de febrero de 2009, que abordan la polémica inscripción de la filiación en el Registro Civil de unos niños nacidos mediante maternidad subrogada en California (EEUU). Se explica la Instrucción de este mismo Centro Directivo, de 5 de octubre de 2010, que da una serie de directrices para validar la relacion filial surgida de ese contrato y que determina, como documento válido para inscribir en el RC dicha filiación, una resolución judicial extranjera. Por último, se aportan las conclusiones y la pertinente bibliografía.
