La presunción de certeza o veracidad de la que gozan determinados hechos plasmados en documentos públicos tras su constatación por funcionarios o agentes de la autoridad, siempre y cuando dichos documentos de carácter público cumplan determinados requisitos formales y sustanciales, ha sido objeto de numerosas críticas y valoraciones debido a su eventual vulneración con el principio de presunción de inocencia. En consecuencia, son múltiples y muy variados los pronunciamientos jurisprudenciales y estudios doctrinales que podemos encontrar al respecto y que precisamente son los que han ido modulando esta figura, que cuenta con lo que podríamos considerar, un reciente y poco clarificador reconocimiento por parte del legislador.
