LA CIRCUNSTANCIA AGRAVANTE DE REINCIDENCIA

Abstract

A lo largo de este trabajo voy a desarrollar un análisis en profundidad sobre la circunstancia agravante de reincidencia recogida en nuestro Código Penal en su artículo 22.8º. Para comenzar, abordo el estudio de la reincidencia enmarcando la agravante dentro de las circunstancias modificativas de la responsabilidad penal. Posteriormente, abordaré un estudio de la reincidencia desde la perspectiva dogmática analizando la Ley positiva incluyendo la nueva reforma del Código Penal y realizando una descripción de las diferentes modalidades que se relacionan con la recaída delictiva. Tras ello, realizo un análisis sobre la problemática de la posible inconstitucionalidad, y para finalizar, desarrollo una síntesis sobre las diferentes posiciones doctrinales acerca de la fundamentación de la circunstancia agravante de reincidencia.

Throughout this end of ear dissertation, a in-depth analysis about the recurrent aggravated circumstance contained in the article 22.8 of our criminal code is going to be carried out it is started by a study on recurrent circumstances delimited by aggavated crimes within penal responsibility. Later on, recurrent crimes are studied from the dogmatic perspective and positive law is analyzed including the new reform of the penal code, carrying out a description of the different sorts related to criminal relapse. Lastly, research on the possibility of its unconstitutionality is carried out as well as the development of a summary on the different doctrinal postures on the fundamentals of the aggravated recurrent relapse.
