El control judicial de la discrecionalidad administrativa

Abstract

El presente trabajo, tiene como objetivo principal estudiar la discrecionalidad administrativa, la cual es objeto de numerosa polémica, sobretodo en el ámbito del control judicial. Esta es una potestad de la Administración, a través de la cual puede optar por varias soluciones, a diferencia de las potestades regladas. En lo referente al control judicial que se realiza sobre la discrecionalidad, las principales técnicas, son aquellas que se encargan del control de los hechos determinantes, el control de los elementos reglados y el control por los Principios Generales del derecho, pues la discrecionalidad debe respetar la ley y el derecho. La discrecionalidad, debe ser diferenciada de la arbitrariedad y uno de los elementos que la diferencian es aquel de la motivación, porque todo acto discrecional debe estar motivado. A modo de referencia, se mostrarán y comentarán algunas sentencias del Tribunal Supremo, pudiendo ver, la importancia de la discrecionalidad.

The present work has as main objective to study the administrative discretion, which is the subject of numerous controversial, especially in the field of judicial control. This is a power of the Administration, through which you can opt for various solutions, unlike the regulated powers. With regard to judicial control which is conducted on the discretion, the main techniques are those that are responsible for controlling the determining factors, control elements and control regulated by the general principles of Law, since the discretion must respect Law and Law. Dsicretion should be differenciated from arbitrariness and one of the elements that differenciate is one of motivation, because all discretionary act must be substantiated. By way of reference, show and comment some judgments of the Supreme Court and can see the impotance of discretion.
