Se pretende con este trabajo realizar un estudio exhaustivo de la reforma llevaba a cabo por la LO 5/201O, de 22 Junio, mediante la cual se introduce la pena de privación de la patria potestad como pena accesoria. Esta intenta resolver algunos de los problemas que se planteaban en relación a la pena de inhabilitación especial para el ejercicio de la patria potestad, fundamentalmente su duración limitada en el tiempo y su restringido ámbito de aplicación, únicamente en aquellas penas de prisión inferiores a diez años. Además, otorga a la jurisdicción penal la posibilidad de poder privar al condenado de dicho derecho sin necesidad de acudir a la jurisdicción civil, al contemplarlo de forma expresa en el Código.
It is intended with this work an exhaustive study of the reform carried out by the LO 5/2010 of 22 June, by which the deprivation of parental rights as an additional penalty 1s introduced. It tries to solve sorne of the problems that arose in relation to the penalty of specific disqualification from the exercise of parental rights, mainly limited time duration and limited scope, only those imprisonment less than ten years. In addition, criminal jurisdiction gives the possibility to deprive the prisoner of that right without recourse to civil jurisdiction, to contemplate explicitly in the Code.
