Rigor innecesario, sanciones y privaciones indebidas

Abstract

Article 533 of Criminal Code penalizes the civil servant who unduly sanctions an inmate or convict from a benefit to which he is entitled or uses unnecessary severity. lt is essential requirement for its application to understand the difference between unnecessary severity and the crime of torture. lt is also important to understand which sanctions and deprivations are allowed, to be able to understand when these are abusive and in addition to understand which severity is unnecessary; this concept is not specified in the Criminal Code. Furthermore, it is indispensable to understand the concept of "moral integrity", which it is another undetermined concept itself, only defined by jurisprudence. Finally, once the legislator leave out the foreigner intemment facilities, it must be identified who are the protected individuals and therefore the deprivation of liberty of foreigners in those centers.

El artículo 533 del Código Penal castiga al funcionario que sanciona de forma indebida a un interno o recluso, le priva de una prestación a la que tiene derecho o usa con él un rigor innecesario. Es fundamental para su aplicación, que hasta nuestros días ha sido reducida, su delimitación con el delito de torturas. Igualmente, es necesario comprender qué sanciones y pnvac1ones están permitidas para comprender cuándo éstas son indebidas y, a su vez, comprender qué es rigor innecesario, concepto indeterminado por el Código Penal. También deberemos comprender qué es la integridad moral, que es a su vez otro concepto indeterminado y que se define a través de la jurisprudencia. Para finalizar debemos identificar quienes son los sujetos protegidos, una vez que el legislador omite los centros de internamiento de extranjeros y por ende a los extranjeros que se encuentran privados de libertad en ellos.
