Abstract

El objetivo de este trabajo se centra en estudiar la protección frente a los actos de competencia desleal en nuestro ordenamiento jurídico. A fin de cumplir dicho propósito, se ha realizado un análisis de la ley encargada de regular de manera fundamental esta materia. A través del mismo, se consigue apreciar el avance que ha sufrido la protección frente a los actos desleales, ampliando su ámbito a todos los que participan en el mercado. En consecuencia, se procede al análisis de la cláusula general prohibitiva de deslealtad y, a posteriori, los supuestos tipificados de forma específica. Siendo esencial, a este respecto, el estudio de las acciones que podrán ejercerse para la defensa de estos actos. Se centra la atención esencialmente en la conducta del engaño, siendo relevante en cuanto que se encuentra estructurada en la Ley de una forma especial. Asimismo, se realiza un análisis jurisprudencia de esta figura.

The aim of this degree work focuses on the study of the protection against unfair cornpetition acts in our legal system. In order to achieve this objective, we study the law which regulate this area. Through this work, we appreciate the progress in the protection of unfair acts, extending the application environment to ali agents taking part in the labor market. Therefore, we examined the general prohibitive clause and specifically established assumptions which will define the behaviors considered unfair. lt is essential to study the legal actions available to defend these unfair behavior. The conduct of deception is studied in depth, which is structured in the Law on a special form. In tum, ajudicial analysis of this figure is performed.
