La huelga y los servicios esenciales

Abstract

[ES] Esta investigación está centrada en conocer el derecho de huelga y los servicios esenciales para la comunidad. La huelga es un procedimiento cualificado de presión colectiva que actúa en defensa de los intereses colectivos de los trabajadores, este, trae consigo el cese temporal del trabajo. El artículo 28.2 de la Constitución Española de 1978, además de regular el derecho a la huelga, reconoce las garantías de los servicios esenciales. En este documento trato de explicar los aspectos más importantes relativos a la huelga y los servicios esenciales; su régimen jurídico, los sujetos titulares, las clases de huelga (tanto lícitas como ilícitas), aunque para conocer las primeras debemos tener claro cuáles son las segundas, la terminación de la huelga, ya que ésta es de duración temporal, los servicios esenciales para la comunidad, los cuales suponen un límite del derecho de huelga, y de estos conocer también su regulación, determinación y alcance, ya que son un aspecto fundamental en el derecho de huelga.

[EN] The strike is a qualified process of collective pressure acting in defense of the collective interests of the workers, this brings a temporary cessation of work. The article 28.2 of the “Constitución Española 1978” in addition to regulating the right to strike, recognizes the guarantees of the essential services. In this document, I try to explain the most important aspects of the strike and essential services; its legal regime, its possessors, the different kind of strike (both legal and illegal), although, to know the legal strikes, we must be clear which are the illegal ones, the end of the strike because it is temporary, the essential services to the community, which imply a limitation on the strike. Also, we talk about its regulation, determination and range because these aspects are essential to the right to strike.
