[ES] Este trabajo consiste en el estudio del delito de trata de seres humanos. Veremos la legislación nacional e internacional sobre el tema y los elementos recogidos en el tipo (acción, medios y fines explotadores), que nos servirán para diferenciar esta figura penal con otros delitos existentes en nuestro ordenamiento jurídico. Analizada la vertiente teórica de la trata de seres humanos, enfocaremos el asunto de manera más práctica estudiando el escrito de conclusiones provisionales y buscando una manera de lograr la libre absolución del acusado o, de manera subsidiaria, lograr la aplicación de un delito con una pena menor.
[EN] This work consists of the study of the crime of human trafficking. We will see national and international legislation on the subject and the elements contained in the type (action, means and exploitative purposes), which will serve to distinguish this figure with other existing criminal offenses in our legal system. Analyzed the theoretical aspect of trafficking in human beings, we will focus the issue in a more practical way studying the essay about provisional conclusions and looking for a way to achieve the acquittal of the accused and, secondarily, to achieve the implementation of a crime with a minor penalty.
