CUESTIONES PRÁCTICAS DE DESLEALTAD EN LA PUBLICIDAD ENGAÑOSA, COMPARATIVA Y DENIGRATORIA

Abstract

La publicidad constituye el método utilizado por los empresarios para incentivar el consumo de sus productos, tratando de llamar la atención de los posibles consumidores para que adquieran lo anunciado. Siguiendo este sendero, la publicidad se trata de una práctica habitual que en ocasiones puede sobrepasar los límites legales. El presente Trabajo de Fin de Grado, tiene por objeto estudiar la regulación de la publicidad comparativa, engañosa y denigratoria en España, abordando el marco de la publicidad desleal y a su vez la legislación que está relacionada con las mencionadas modalidades de publicidad, analizando los rasgos más importante de la legislación relacionada, aquellos mecanismos de defensa y aquellos pronunciamientos de la jurisprudencia más destacables.
