LA TRANSMISIÓN DEL RIESGO EN LA COMPRAVENTA INTERNACIONAL DE MERCADERÍAS

Abstract

La transmisión del riesgo en la compraventa internacional de mercaderías es un elemento esencial a la hora de la entrega de la mercancía y la responsabilidad frente a daños o deterioros de la misma, entre el comprador y el vendedor. Actualmente existen diferentes normas que regulan este riesgo, como la Convención de Viena de 1980 que se analizará exhaustivamente en este trabajo o algunas reglas que regulan este riesgo también, llamadas INCOTERMS. Es esencial para la compresión de este riesgo saber el significado de elementos generales tales como la compraventa o las mercancías, y también la comparación de la normativa con la aplicación de ésta a la práctica.

The transmission of the risk in the international sale of goods is an assential element when delivering the goods and liability for damage or deterioration thereof, between the buyer and the seller. There are currently different rules governing this risk, such as the 1980 Vienna Convention to be thoroughly discussed in this work or some rules that regulate the risk as well, called INCOTERMS. It is essential for understanding this risk to know the meaning of general elements such as sales of goods, and also the comparison of the rules with the application of the regulation to the practice.
