El derecho al debido proceso sin dilaciones indebidas y con todas las garantías constituye una exigencia legal a nivel nacional, comunitario e internacional del Estado de Derecho a fin de garantizar una efectiva Administración de Justicia. El Capítulo VII del Título XX del Código Penal español recoge una serie de conductas orientadas a garantizar la efectividad de la labor del Poder Judicial en su actual configuración dentro del Estado Social y Democrático de Derecho español. Los delitos sobre los que versa el presente trabajo constituyen las conductas obstructoras y desleales al correcto funcionamiento de la Administración de Justicia más graves, en virtud del principio de intervención mínima del Derecho Penal. Aunque también constituyen infracciones administrativas y disciplinarias. Mediante este estudio se realiza un análisis sistemático de los mismos con breves remisiones a la legislación, a los debates doctrinales más relevantes y la jurisprudencia desarrollada al respecto.

The right of being tried without undue delay with every guarantee is a legal requirement of the national, communitary and international development of every rule of law country to ensure more effective judicial protection. Chapter VII, Title XX of the spanish Penal Code contains a set of stipulations to ensure the effectiveness of the Judicial Branch in the social and democratic state governed by the rule of law. The offences addressed in this work are the most severe obstructives and unfaithful practices to the proper functioning of THE admistration of justice according to the the principle of the 'minimally sufficient' intervention. It also can be administrative or disciplinary offenses. With this work we study them with referrals to the legislation, the long doctrinal debates and the jurisprudence.
