En este estudio se investiga sobre el uso de la fuerza por parte de FFCCSE, desde una perspectiva jurídica, siendo conscientes de la dificultad de este estudio, comenzamos la investigación analizando la legitimidad que tienen estos cuerpos para poder ejercer el uso de la fuerza de forma justificada, comprobando pues que el uso de la fuerza por FFCCSE estará justificado en la legitimidad dada por los ciudadanos al propio Estado, el cual conserva el monopolio del uso de la fuerza y la emplea mediante las FFCCSE. Para finalizar analizamos a modo de crítica diversos casos en los cuales el TEDH condenó al Estado Español por no investigar las posibles torturas sufridas por detenidos en dependencias policiales, concluyendo que esto supone un déficit democrático.
This study investigates the use of force by the FFCCSE, from a legal perspective, being aware of the difficulty of this study, we begin the investigation by analysing the legitimacy of these bodies to be able to exercise the use of force in a justified manner, thus proving that the use of force by the FFCCSE is justified in the legitimacy given by citizens to the state itself, which retains the monopoly on the use of force and employs it through the FFCCSE. Finally, we critically analyse various cases in which the TEDH condemned the Spanish state for failing to investigate possible torture suffered by detainees in police custody, concluding that this represents a democratic deficit.
