Abstract

[ES]El contrato de gestación por sustitución es cada vez es más popular en España,. Mi objetivo es realizar un estudio jurídico-constitucional con una perspectiva de género del contrato de gestación por sustitución. Se analiza la regulación española sobre la gestación por sustitución así como un estudio de derecho comparado del contrato de gestación por sustitución en distintos países. Se analizan los derechos que entran en conflicto al exigir la gestación por sustitución y sus efectos jurídicos. Se realiza un estudio de la jurisprudencia española así como de las instrucciones de la Dirección General de los Registros y del Notariado y se analizan diversas sentencias del Tribunal Europeo de Derechos Humanos. PALABRAS CLAVE: gestación por sustitución, mujer, menor, contrato y dignidad.

[EN]The contract of pregnancy by substitution is increasingly popular in Spain. My objective is to carry out a legal- constitutional study with a gender perspective of the aforementioned contract. The Spanish regulation on the pregnancy by substitution is analyzed as well as a study of comparative law of the contract of pregnancy by substitution in different countries. The rights that conflict when demanding pregnancy by substitution and their legal effects are analyzed. A study of the Spanish jurisprudence as well as the instructions of the General Directorate of Registries and Notaries is carried out and various judgments of the European Court of Human Rights are analyzed.
