Abstract

RESUMEN En el presente Trabajo de Fin de Grado, tengo como objeto de estudio analizar El Delito de Cohecho, tipificado en el Título XIX del CP, Delitos Contra la Administración Pública. Dada la amplitud de este delito y las peculiaridades del mismo, me centraré en el cohecho pasivo propio, regulado en el art 419 CP, haciendo referencia a las distintas modalidades y aspectos distintivos de esta modalidad de cohecho, y en especial haremos alusión al cohecho pasivo impropio, art 420 CP. Por otro lado, estableceremos las diferencias con su opuesto el cohecho activo, art 424. CP. De manera previa, haré hincapié en las distintas reformas operadas entorno al delito de cohecho y aspectos fundamentales a saber con anterioridad al hablar de la modalidad de cohecho. Delimitaremos el bien jurídico protegido, dada las distintas opiniones doctrinales al respecto. Y, por último, se desarrolla la modificación del concepto de funcionario público extranjero, art 427.CP. ABSTRACT The objective in this degree thesis is to analyse the crime of Cohecho, listed in section XIX of penal code, Crimes against the Public Administration. Given the wide-ranging nature of this crime and its peculiarities, I will focus on passive cohecho, regulated by article 419 of de penal code, making reference to the different forms and aspects of this type of Cohecho, and also on passive cohecho, article 420 of the penal code. I will also establish the differences with relation to active cohecho (bribery), article 424 of the penal code. First, I will emphasise the different reforms enacted around the crime of cohecho, and fundamental aspects to consider before dealing whit the form of cohecho. I will also define the protected legal right, given the different doctrinal opinions on this. And finally, it develops the modification of the concept public servant, art 427 of the penal code.
