Abstract

Pocos impuestos, en el sistema tributario español, generan una problemática similar al Impuesto sobre Sucesiones y Donaciones; esta situación está provocada, por un lado, por tratarse de un impuesto cedido por parte del Estado a las Comunidades Autónomas, las cuales tienen capacidad de regular diferentes aspectos del impuesto y, por otro lado, al englobar dos hechos imponibles independientes pero que, en esencia, cumplen un mismo objetivo, la transmisión de bienes y derechos por parte del titular de los mismos. A lo largo de este trabajo se tratará de ofrecer una comparación exhaustiva entre ambos hechos imponibles, comparando ambas modalidades de tributación, mortis causa e inter vivos, así como la normativa específica de tributación en cada comunidad autónoma. Además, a través de la exposición de unos casos prácticos, se pondrá de manifiesto las diferencias entre ambas modalidades de tributación, así como las diferencias existentes entre comunidades autónomas. Few taxes, in the Spanish tax system, generate a problem similar to the Tax on Inheritance and Donations; this situation is caused, on the one hand, by being a tax assigned by the State to the Autonomous Communities, which have the capacity to regulate different aspects of the tax and, on the other hand, by encompassing two independent taxable events but which, in essence, they fulfil the same objective, the transfer of goods and rights by the owner of the same. Throughout this work, we will try to offer an exhaustive comparison between both taxable events, comparing both forms of taxation, mortis causa and inter vivos, as well as the specific tax regulations in each autonomous community. In addition, through the presentation of the practical cases, the differences between the two tax modalities will be shown, as well as the affected differences between the autonomous communities.
