Abstract

La mediación es un elemento emergente, vigente y relacionado profundamente con lo social y jurídico, y su desarrollo pretende ofrecer una alternativa al proceso judicial. De igual forma, la mediación, se contextualizará también como una herramienta de paz social que logre una mayor cooperación cívica, con el fin de solucionar los conflictos y atendiendo a una percepción amplia de hacer justicia desde y para los involucrados. Por lo que el presente Trabajo Fin de Grado pretende dar a conocer en qué consiste la mediación, los principios de la mediación, la figura del mediador, los tipos de mediación existentes, especialmente la Mediación Penal con menores infractores, siendo ésta en la que se va a centrar esta investigación, así como las ventajas e inconvenientes de la Mediación ante un proceso judicial.

Mediation is an emerging element, in force and deeply related to the social and legal, and its development aims to offer an alternative to the judicial process. Likewise, mediation will also be contextualized as a social peace tool that will achieve greater civic cooperation, in order to resolve conflicts and attending to a broad perception of doing justice to and from those involved. For this reason, the purpose of this Final Degree Project is to make known what constitutes mediation, the types of mediation that exist, the principles of mediation, the mediator, especially the Criminal Mediation with minor offenders, will focus this research, as well as the advantages and disadvantages of Mediation before a judicial process.
