SANCIONES ADMINISTRATIVAS. ÁMBITO DE TRÁFICO.

Abstract

Este trabajo trata en general del ámbito sancionador de la Administración, en cuanto a la potestad sancionadora de la que dispone la misma, centrándonos un poco y estudiando algunos detalles como pueden ser el tiempo de prescripción, la caducidad etc. Citando algunas sentencias importantes como puede ser la de 7 de abril de 1981 o la de 18 de diciembre de 1991, e incluso haciendo mención a algunos artículos importantes para llevar a cabo este trabajo, los cuales pueden ser el artículo 132 de la LRJPAC. Pero sobretodo nos centramos en el ámbito de estas sanciones en cuanto al tráfico nos referimos. En el estudio del ámbito del tráfico tratamos temas como pueden ser hasta qué cierto punto una sanción actúa como herramienta educativa y cuándo deja de serlo para ser simplemente una sanción administrativa, y otros diversos temas como pueden ser los responsables subsidiarios y solidarios que habrán de hacer frente a estas sanciones. This work deals in general about the sanctioning field of the Administration, in terms of the sanctioning power available to it, focusing a bit and studying some details such as the time of prescription, expiration etc. Citing some important judgments such as be that of April 7 1981 or December 18, 1991 and even mentioning some important articles to carry out this work, which may be article 132 of LRJPAC. But above all, we focus on the scope of these traffic sanctions. In the study of the field of trafficking, we address issues such as to what extent a sanction acts as an educational tool and when it ceases to be an administrative sanction, and various other issues such as the subsidiary and solitary managers who will have to face to these sanctions.
