Abstract

Parliamentary immunity is not understood as a personal privilege that is attributed to deputies, both Spanish and European, it is a prerogative that guarantees that the members who enjoy immunity can get to exercise their function or mandate freely, without being object of political persecution. We can define immunity as a guarantee based on the independence and integrity of Parliament. The members who enjoy immunity cannot be the object of a judicial process that derives from the exercise of their functions; therefore, they cannot be detained or investigated without prior authorization. The objective of this work is to gain an in-depth understanding of the concept of "Immunity" both in Spanish territory and in the EU, establishing its origin and background, making a comparison and differentiating the term "Immunity" from "inviolability"
