Desistimiento en la contratación electrónica internacional.

Abstract

Internet es un medio clave para realizar transacciones entre consumidores. La contratación electrónica supone una expansión tanto a nivel nacional como internacional. El intervencionismo estatal en este tipo de contratos privados es cada día más patente en cuanto a la finalidad de establecer una igualdad de fuerzas en la contratación. El derecho a desistir en la contratación electrónica internacional constituye una serie de conflictos ya que cada país tiene sus propias normas. El DIPr debe garantizar la continuidad y seguridad jurídica de todas las relaciones que traspasan las fronteras de los países así como permitir al contratante elegir la ley aplicable a su contrato y el juez competente en que para resolver sus problemas pueden optar por un tribunal arbitral. En la contratación a distancia, se establecen distintas normativas entre las cuales cabe destacar el Reglamento Roma I entre otras. The Internet is a key means of conducting transactions between consumers. Electronic procurement is an expansión both nationally and internationally. State interventionism in such private contracts is becoming increasingly clear about the aim of establishing equal forces in recruitment. The right to give up on international e-procurement constitutes a series of conflicts as each country has its own rules. Private international law must ensure continuity and legal certainty of all relations that cross the borders of countries as well as allowing the contractor to choose the law applicable to his contract and the competent judge where to solve their problems they can opt for an arbitral tribunal. In remote procurement, different regulations are established, among which it is worth highlighting the Rome I Regulation among others.
