[ES] Las comunidades de bienes se presentan como una forma de asociación sencilla entre dos o más personas, llamadas comuneros. Esta asociación puede constituirse para emprender un negocio o incluso de manera incidental, esto es, ajena a la voluntad de sus integrantes. En base al hecho de carecer de personalidad jurídica, se han planteado diversos debates sobre la capacidad jurídica y de obrar que puedan tener o no estas figuras. Por este motivo se ha realizado un estudio sobre las generalidades de las comunidades de bienes, para obtener un amplio conocimiento de las mismas, y en segundo lugar se han tratado los criterios de las distintas posiciones de los debates mencionados, así como una investigación sobre si las comunidades de bienes pueden ser o no titulares de vehículos en la Dirección General de Tráfico en base a su carencia de personalidad jurídica.
[EN] Communities property are a type of simple association between two or more people, who are called common members. This association can be made to start a business or even by an accidental way, meaning that it is out of the members’ choice. Because of their lack of own legal entity, several debates have been made about the legal and acting capacities that these figures can have or not. Based on this, a study has been made about communities property generalities, in order to get a complete knowledge of them, and in second place another one has been made about the different reasons that the debates’ parts have to defend their positions. Also an investigation about the possibility for them of appearing or not as owners at the General Administration of Traffic, based on their lack of own legal entity.
