LA INVIOLABILIDAD DEL DOMICILIO EN LAS CONSTITUCIONES ESPAÑOLAS

Abstract

[ES] El presente trabajo trata sobre la inviolabilidad del domicilio en la historia constitucional del derecho español desde la Constitución de 1812 hasta la actualidad. En primer lugar, se hace una breve reseña del contexto histórico en el que se desarrollaron los textos constitucionales españoles objetos de estudio, y posteriormente antes de proceder a abordar como se desarrolla el derecho de la inviolabilidad del domicilio en cada texto, se realiza un análisis de que derechos fundamentales se protegían en cada Constitución y de qué forma. Después del estudio del contexto histórico y los derechos fundamentales, se estudia el derecho de la inviolabilidad del domicilio en cada texto constitucional, observando la forma de redacción, que medidas se utilizaban para garantizar este derecho y la posible regulación de este en diferentes textos legales, como podían ser el Código Penal o la Ley de Enjuiciamiento Criminal. Finalmente, se realiza el estudio del derecho de la inviolabilidad del domicilio en otros ordenamientos jurídicos.

[EN] The present work deals with the inviolability of the domicile in the constitutional history of Spanish law from the Constitution of 1812 to the present. First, a brief review of the historical context in which the Spanish constitutional texts were developed is studied, and then before proceeding to address how the right of inviolability of the domicile is developed in each text, an analysis is carried out. that fundamental rights were protected in each Constitution and in what way. After the study of the historical context and fundamental rights, the law of the inviolability of the domicile in each constitutional text is studied, observing the form of writing, what measures were used to guarantee this right and the possible regulation of this in different legal texts, such as the Criminal Code or the Law of Criminal Procedure. Finally, the study of the law of the inviolability of the domicile in other legal systems is carried out.
