Las Prerrogativas Parlamentarias en el Ordenamiento Jurídico Español

Abstract

[ES] Asistimos a un escenario político convulso y repleto de propuestas políticas que entre otras cosas buscan una mayor cercanía con el ciudadano. Una de las propuestas más recurrentes es la eliminación de la figura del aforamiento parlamentario. Esta figura consiste en una garantía procesal que supone ser juzgado por un Tribunal Superior de Justicia en lugar de un tribunal ordinario. Considerado para algunos un privilegio que choca con el principio de igualdad, y en cambio para otros una figura necesaria. En este trabajo se analiza las prerrogativas parlamentarias: inmunidad, inviolabilidad y aforamiento. Se compara la peculiar situación de las mismas en España respecto a los países de nuestro entorno. Producida por un abuso de las mismas y una desviación del objetivo principal, ya que actualmente parecen concebidas como un privilegio personal. Fruto de esta necesidad, actualmente existe un anteproyecto de reforma constitucional. En este trabajo se expone su alcance y las principales posturas políticas al respecto. [EN] We attend a convulsed political scene and full of political proposals that, among other things, seek greater closeness to the citizen. One of the most recurrent proposals is the elimination of the figure of the parliamentary “aforamiento”. This figure consists of a procedural guarantee that is to be judged by a Higher Court of Justice rather than an ordinary court. Considered for some a privilege that clashes with the principle of equality, and instead for others a necessary figure. This paper analyses parliamentary prerogatives: immunity, inviolability and “aforamiento”. It compares the peculiar situation of the same in Spain with respect to the countries of our environment. Caused by an abuse of the same and a deviation from the main objective, as they currently seem conceived as a personal privilege. As a Result of this need, there is currently a draft constitutional reform. This paper exposes its scope and the main political stances.
