LA REFORMA DEL IMPUESTO SOBRE SUCESIONES Y DONACIONES EN ANDALUCÍA

Abstract

[ES] La finalidad del Impuesto sobre Sucesiones y Donaciones es contribuir al sostenimiento del gasto público a través de la tributación de los sujetos pasivos. El presente trabajo analiza las características de este tributo cedido a las Comunidades Autónomas, y como éstas afectan a los contribuyentes, al existir desigualdades de trato dependiendo del lugar de residencia habitual del sujeto pasivo o de la localización del inmueble. La jurisprudencia del Tribunal de Justicia de la Unión Europea y del Tribunal Supremo, nos hacen ver cómo la desigualdad afecta a las libertades comunitarias y extracomunitarias de los diferentes contribuyentes. Analizamos las modificaciones introducidas en la normativa del Impuesto en Andalucía en los dos últimos años; realizamos un estudio comparativo con el resto de Comunidades Autónomas de régimen común. Finalmente, reflexionamos sobre las posturas doctrinales para la modificación del Impuesto a fin de conseguir una mayor armonización, o bien la definitiva abolición del mismo.

[EN] The purpose of Inheritance and Donations Tax is to contribute to the maintenance of public spending through the taxation of taxpayers. This paper aims to analyze the characteristics of this tax assigned to the Autonomous Communities, and how they affect taxpayers, since there are inequalities of treatment depending on the place of habitual residence of the taxpayer or the location of the property. The jurisprudence of the Court of Justice of the European Union and the Supreme Court enables us to see how inequality affects the community and extra-community freedoms of different taxpayers. We analyze the modifications introduced in the tax regulations in Andalusia in the last two years; we also carry out a comparative study with the other Autonomous Communities of the common system. Finally, we reflect on the doctrinal positions for the modification of the tax to achieve greater harmonization, or the definitive abolition of it.
