El derecho de patentes y la competencia desleal.

Abstract

[ES] El siguiente trabajo, tiene como objetivo analizar una parte imprescindible del derecho industrial español, como es tanto el derecho de patentes como el derecho de la competencia desleal, al igual que sus regulaciones. De un lado el derecho de patentes con la Ley 24/2015 de 24 de Julio, analizamos por un lado su régimen jurídico, en el que encontramos tanto el objeto, como patente internacional o una comparativa entre la antigua ley de patentes y la actual, y por otro lado el contenido, solicitud y concesión. Además de esto, abordamos también la ley 3/1991 de 10 de enero, de Competencia Desleal, cuya finalidad es principalmente la de prohibir una serie de actos desleales. En ella analizaremos tanto la cláusula general como la cláusula especial prohibitiva de la deslealtad, junto con una serie de actos de competencia desleal que se producen en el mercado. Del mismo modo, se desarrollara un análisis jurisprudencial de las anteriores figuras jurídicas, finalizando por ultimo con una serie de conclusiones.

[EN] The objective in this essay is to analyse a crucial part of spanish Industrial Law. It´s as important as Patent Right and the Unfair Competence Law. Also, we found its regulations in the composition. On the one hand, we examine the juridical regime of Patent Right, with the 24/2015 law on 24th July. In this regime, we found the subject as an international patent or as a comparative between the ancient patent law and the new one. On the other hand we will focus on the content, the application and the concession. Apart from this, we will talk about the 31/1991 law on 10th January, the Unfair Competence Law, whose objective is forbiding some unfair behaviours. We will deal with the general clause and the Special Prohibitive Clause of Disloyalty. We see some acts from Unfair Competence which are caused in bussines. In the same way, we develop a jurisprudental analyse about last juridical objects. Finally, we will submit some conclusions.
