Abstract

[ES] El presente trabajo estudia la figura del divorcio, una de las crisis matrimoniales que según el Instituto Nacional de Estadística ha aumentado considerablemente en nuestro país, y mi investigación se centra desde un punto de vista procedimental. Se inicia con un análisis de los antecedentes legales del divorcio en España y las reformas que ha sufrido y evolución hasta la actualidad. Continuamos citando las diferentes autoridades a las que poder acudir en caso de divorcio y sus peculiaridades, así como los efectos y medidas que afectan a la disolución matrimonial. Dedicamos un epígrafe a los trámites procesales específicos del divorcio en caso de violencia de género. Se plantea la mediación familiar como una medida alternativa al divorcio, y se concluye desarrollando las posibilidades del divorcio en la Unión Europea, los procedimientos a seguir entre cónyuges de diferentes Estados, y el órgano competente para conocer y la ley aplicable en cada caso.

[EN] This paper studies the concept of divorce, one of the marriage crises that according to the National Institute of Statistics has increased considerably in our country, and my research focuses on a procedimental point of view. It begins with an analysis of the legal history of divorce in Spain and the reforms that it has undergone and has evolved to this day. We continue to cite the different authorities to which to turn in case of divorce and its peculiarities, as well as the effects and measures that affect the dissolution of marriage. We devote a heading to the specific procedural procedures of divorce in cases of gender violence. Family mediation is envisaged as an alternative to divorce, and is concluded by developing the possibilities of divorce in the European Union, the procedures to be followed between spouses from different states, and the body competent to know and the law applicable in each case.
