CAN BE GENERAL THE GENERAL THEORY OF LAW?

Abstract

Durante los dos últimos siglos se ha caracterizado a la Teoría del Derecho como una disciplina “general” acerca de la naturaleza o del concepto de Derecho. Tras una breve caracterización del significado de una teoría general, este trabajo acometerá la principal crítica que se ha dirigido hacia tal tipo de teorías en el Derecho: su utilidad. A partir de ahí, el presente trabajo se estructurará en dos partes. Por un lado, se enfrentará a dos grandes cuestiones abiertas y de marcado carácter semántico acerca de la viabilidad de una teoría general del Derecho, como la cuestión de si la tarea general debe enfocarse sobre la naturaleza del Derecho o sobre su concepto y el problema de caracterizar algo tan cambiante como el Derecho. Por otro lado, se pretenderá dar un enfoque plausible de la teoría general del Derecho partiendo de la idea clave de que el atributo de generalidad es predicable sólo de la teoría (y, en concreto, de una teoría naturalizada), pero no del concepto de Derecho. During the last two centuries the Theory of Law has been characterized as a "general" discipline concerning the nature or the concept of law. After a brief characterization of the meaning of a general theory, this paper will undertake the main criticism which has been directed toward such a sort of theories in law: its utility. Thereafter, this paper will be structured in two parts. On the one hand, it will face two major open strongly semantic questions on the feasibility of a general theory of law, such as the issue of whether the overall task should focus on the nature of the law or on its concept and the problem of characterizing something as changeable as the law. Furthermore, we will try to give a plausible approach to the general theory of law based on the key idea that the attribute of generality is predicable only about the theory (and in particular, about a naturalized theory), but not about the concept of law.
