La circunstancia agravante de reincidencia en el derecho penal juvenil

Abstract

El presente trabajo profundiza en la regulación de la reincidencia en el ámbito del Derecho penal de menores, en particular la previsión de efectos en el régimen de determinación de la medida juvenil. En este ámbito la culpabilidad por el hecho constituye un límite infranqueable, lo que sitúa en un primer plano al sistema de circunstancias modificativas de la responsabilidad penal para el adulto. Bien entendido que no se trata de incorporarlo, sino de establecer parámetros fijos y estables. Sirvan de ejemplo la prohibición de responder frente al menor de forma más restrictiva que frente al adulto o la obligación de considerar las peculiaridades de la culpabilidad del adolescente. Unas y otras constituyen una garantía irrenunciable frente a los abusos que se pueden ejercer en nombre de la prevención especial e incluso de la consecución del superior del menor. Abstract: This paper explores the regulation of recidivism in the area of juvenile criminal law, particularly in its legal effects in the system of individualization of programs for juveniles. In this area, factual blameworthiness is an insurmountable barrier, which brings to the fore the system of factors modifying criminal liability set for adults. Understood that it is not proposed to import this system, but to establish likewise fixed and stable parameters. Examples include the prohibition of reacting to juveniles more restrictively than against adults, or the obligation to consider the peculiarities of blameworthiness in teenagers. Both principles are irrevocable guarantee against abuses that could be exercised on behalf of special deterrence and even of the supreme interest of juveniles.
