La regulación económica de las industrias de red ha sido un tema relevante de estudio enlas últimas décadas. La implantación del abastecimiento de agua —en sus diversas etapas— ha generado la aparición de una compleja trama legislativa y económica, que ha provocado un cambio en la aplicación del concepto de servicio público. El viejo monopolio de titularidad estatalha dejado paso a un sistema de regulación, que trae consigo un nuevo proceso de organización. La competencia de los mercados, la eficiencia y el papel que desempeñan empresasy ayuntamientos son algunas de las características de este inédito planteamiento. Este trabajo se propone analizar la evolución que ha experimentado la regulación de este servicio entre mediados del siglo xix y las últimas décadas del siglo xx.
The economic regulation of network industries has been a relevant research topic in recent decades. The establishment of drinking water supply – at its various stages –generated the development of a complex legislative and economic framework, which provoked a change in the application of the concept of a “public service”. The old monopoly of state ownership gave way to a system of regulation, implying a new type of organization. Market competition, efficiency and the roles that companies and city councils play are some of the features of the new approach. This paper is aimed at analysing the evolution of regulation in this service between the mid-19th century and the final decades of the 20th century.
