Abstract

Los resultados de la investigación presentada van dirigidos: 1. Respecto a la financiación de la vivienda a través del crédito hipotecario. a) Propongo avanzar en una catalogación de las operaciones de préstamos hipotecarios que distinga el carácter residencial del comercial y, dentro del primero, las segundas residencias y el sujeto adquirente (persona física o jurídica); en una reducción de la presión fiscal y de los formalismos y rigideces registrales que lastran la renegociación de las hipotecas. b) Evitar poner parches a situaciones realmente desastrosas para la economía y los consumidores, y ello sólo se consigue distinguiendo entre los efectos de la crisis económica y los problemas del mercado hipotecario. 2. En cuanto a la vivienda como alojamiento turístico. a) Se avanza en la delimitación de los negocios oferentes de alojamiento cuando es particular (plataformas) y cuando es empresario. b) La modificación sobrevenida de los estatutos comunitarios no torna en ilícita la comercialización ya emprendida de los pisos por quien adquirió cerciorándose de que no existía restricción alguna en los estatutos
