El constitucionalismo colonial de Alexis de Tocqueville: civilización, religión y derechos

Abstract

The colonization of Algeria raised from the beginning a conflict/contradiction between facts and principles, namely the conquest and domination of a foreign people and the principles of liberalism and the rule of law that governed in France. Alexis de Tocqueville participated as an elected representative in the national debate on the Algerian question. Tocqueville’s position assumed a historical narrative that saw in the progress of the Christian civilization and the regression of the Muslim an unstoppableevent. His opinion was favorable to the French presence in North Africa, despite the fact that he had criticized French policy in the conquered territories. In the present article I study the difficult task undertaken by Tocqueville to reconcile his liberalism with the African colonial expansion. I also develop the principles and measures that in his opinion should preside over the French government in Algeria. It is from this perspective that I approach Tocqueville's criticisms of the government system implemented in the regency, the lack of protection of the rights of the settlers, as well as his denunciations of the treatment received by the Arab aborigines and kabyles.

La colonización de Argelia planteó desde el primer momento un conflicto entre las actuaciones propias de la conquista y dominación de un pueblo extranjero y los principios propios del liberalismo y del Estado de Derecho que regían en Francia. Alexis de Tocqueville participó como diputado en el debate nacional sobre la cuestión argelina. Su postura fue desde el principio favorable a la presencia francesa en el norte de África, aunque criticara la política francesa en los territorios conquistados. En el presente artículo se estudia la difícil tarea emprendida por Tocqueville de conciliar su liberalismo con la expansión colonial africana, así como los principios y medidas que en su opinión debían presidir el gobierno francés en Argelia. En este sentido se analizan las críticas de Tocqueville al sistema de gobierno implantado en la regencia, la falta de protección de derechos de los colonos, así como sus denuncias del trato recibido por los aborígenes árabes y cabilas. Y todo ello partiendo de una narrativa histórica que veía en el progreso de la civilización cristiana y la regresión de la musulmana un acontecimiento imparable.
