La paradoja en la aplicación del Derecho a Comprender en España. Una revisión normativa

Abstract

En España se han alcanzado muchos hitos en relación con el derecho a comprender a lo largo de los últimos años, y este se ha positivizado mediante la denominada “accesibilidad cognitiva”, a través de normas recientes como la Ley 6/2022 o la 5/2024, que situaron al país a la cabeza de la regulación de dicha accesibilidad. En su contenido, tales normas definen y regulan directamente dichas cuestiones; sin embargo, todas ellas acusan la paradoja de que han sido redactadas de forma tradicional, sin pautas de lenguaje claro ni adaptaciones a lectura fácil, lo que las convierte en textos incomprensibles para la mayor parte de la ciudadanía, con lo que se incumple lo que se garantiza proteger. De ese modo, por medio de un análisis cronológico de la normativa más relevante en la materia, se intenta explicar esta paradoja y entender las raíces y la proyección de este derecho. Finalmente, se diseña una propuesta de adaptación a la lectura fácil de al menos una de ellas.

In recent years, Spain has achieved numerous milestones regarding the right to understand, which has been enshrined in law through the concept of “cognitive accessibility.” This has been accomplished through recent legislation such as Law 6/2022 and Law 5/2024, positioning the country at the forefront of regulating this type of accessibility. These laws explicitly define and regulate the relevant issues; however, they all share a paradox: they have been drafted in a traditional legal style, without the use of plain language guidelines or easy-to-read adaptations, making them largely incomprehensible to the general public. As a result, they fail to uphold the very right they claim to protect. Through a chronological analysis of the most relevant legislation on the subject, this paper seeks to explain this paradox and explore the roots and future prospects of this right. Finally, it proposes an easy-to-read adaptation of at least one of these legal texts.
