¿Poco importa el Congreso?. Un análisis de la ratificación de tratados comerciales y aduaneros

Abstract

Este trabajo se propone identificar cuáles son los factores que inciden en la velocidad con la que se ratifican los tratados comerciales y aduaneros por el Congreso colombiano. Para lograr este objetivo se realizó un recorrido por la literatura de los tratados comerciales y el funcionamiento del Congreso. Con esto se construyó un argumento teórico que propone lo siguiente: por un lado, la presencia de congresistas de corte izquierdista haría más lento el proceso y, por otro lado, sectores económicos fuertes indicarían grupos de presión con mayores capacidades de favorecer medidas proteccionistas, que demoraría la aprobación de los acuerdos comerciales. De esta forma, a través de un modelo de supervivencia, que analizó los tratados comerciales y aduaneros ratificados por Colombia de 1965 a 2019, se comprobó que estas dos variables son estadísticamente significativas. Efectivamente, ante un mayor número de congresistas de izquierda la ratificación requiere más días. Sin embargo, contrario a la suposición inicial, un sector agrícola fortalecido favorece una ratificación más ágil de tratados. Estos resultados son de gran importancia porque contradicen lo normalmente expuesto por la literatura sobre política exterior colombiana y abren el camino para que nuevos estudios tomen diferentes enfoques.
