Eficacia jurídica de beneficios pensionales consagrados en convenciones colectivas de trabajo

Abstract

A partir de la entrada en vigencia del Acto Legislativo 01 del 22 de julio de 2005, e invocando la sostenibilidad financiera del Sistema Pensional, quedó prohibido establecer beneficios pensionales en convenciones colectivas de trabajo, afectando directamente a los trabajadores en Colombia, y vulnerando directamente derechos fundamentales constitucionales y supranacionales como es el derecho a la negociación colectiva y el derecho de asociación.
