Introducción al derecho ambiental

Abstract

La problemática ambiental plantea a los operadores jurídicos enormes desafíos para dar respuestas a nuevas y acuciantes necesidades sociales. En esa tarea, despiertan interés de la doctrina, el estudio de los principios rectores de derecho ambiental, y el análisis de institutos clásicos, que por insuficiencia disfuncional, están en franca revolución. Desde el sistema jurídico sustantivo de la responsabilidad civil por daños, en especial del daño ambiental colectivo o de incidencia colectivo (daño al ambiente en sí mismo), y su variante extrapatrimonial supraindividual, del daño moral colectivo, y en casos cocausación, concurrencia de causas, concausas, introducción de un régimen propio para supuestos de “responsabilidad colectiva o anónima”. Preocupa, además, la relación de causalidad del daño ambiental. Desde la óptica procesal, las cuestiones de legitimación del obrar en las causas ambientales, la carga de la prueba, apreciación de la prueba, los efectos de la cosa juzgada, el perfil o rol del juez y la prueba del daño ambiental. Y con una visión de unidad de la regulación normativa sustantiva-procesal, la valoración del daño ambiental.
