Primacía de la realidad frente al contrato de prestación de servicios en el sector salud

Abstract

El contrato de prestación de servicios profesionales es ante todo un instrumento de gestión utilizado en la empresa privada y la administración pública, para vincular temporalmente a personas naturales al servicio de sus organizaciones, orientándolos al cumplimiento de sus objetivos estratégicos, mediante el cumplimiento de una serie de cometidos que buscar satisfacer necesidades particulares en el sector privado y necesidades de interés general que están ligadas exclusivamente al aparato estatal. La aparente razón de que la administración pública y especialmente en las Empresas Sociales del Estado utilice la modalidad de contratación por prestación de servicios profesionales, es el que no se paralice la atención en los servicios de salud a los usuarios y que no se ponga en riesgo el interés general por la carencia del personal o conocimientos específicos que el personal de planta no puede satisfacer y los cuales son necesarios y se requieren para atender la demanda de salud.
