La modalidad procesal de impugnación del despido colectivo

Abstract

RESUMEN: La reforma laboral de 2012, articulada por el Real Decreto Ley 3/2012, de 10 de febrero, y la posterior Ley 3/2012, de 6 de julio, de medidas urgentes para la reforma del mercado laboral, introdujo una serie de modificaciones normativas en el régimen jurídico de los despidos colectivos, afectando de manera significativa tanto al ajuste en las causas económicas del despido como al procedimiento formal que debe seguir la empresa para efectuar las extinciones laborales, donde destaca principalmente la supresión de la autorización administrativa que facultaba al empresario a realizar el despido. Consecuentemente, con las novedades incorporadas en el régimen sustantivo del despido colectivo, se hizo necesaria una adaptación del procedimiento para su impugnación judicial. Para ello, se da una nueva redacción al art. 124 de la LRJS, regulando una novedosa y compleja modalidad procesal que articula el procedimiento de impugnación de los despidos colectivos, distinguiendo entre una impugnación de carácter colectivo y una impugnación de carácter individual. Por tanto, en el presente estudio, se analizarán los aspectos más relevantes de esta modalidad procesal.

ABSTRACT: The labor reform of 2012, articulated by RDL 3/2012, of February 10, and the subsequent Law 3/2012, of 6 July, on urgent measures to reform the labor market, introduced a series of regulatory changes in the legal regime of collective redundancies, affecting significantly both to fit into the economic causes of dismissal as the formal procedure to be followed by the company to perform the work extinctions, which mainly emphasizes the elimination of administrative authorization that authorized the employer to perform the dismissal. Consequently, with the new features in the substantive rules on collective redundancies, it was necessary an adaptation of the procedure for judicial challenge. For this, a redraft the art is given to the article 124 LRJS, regulating a novel and complex procedural method that articulates the challenge procedure of collective redundancies, distinguishing between a challenge and a challenge collective nature of individual character. Therefore, in this study, the most important aspects of this procedural method will be discussed.
